Welcome to use the related services of Guangzhou Fairland Technology Co., Ltd.!

Before accepting this agreement, please be sure to read the entire content of this agreement carefully and fully understand the terms, especially the limitation or exemption clauses. The limitation or exemption clauses will remind you in bold or other prominent forms. If you have any questions about the terms of this agreement, please contact the relevant business department of Guangzhou Fairland Technology Co., Ltd. for inquiries. Unless you have read and accepted all terms of this agreement and related agreements, rules, etc., you have no right to use this service. Once you choose " A gree to the agreement and submit" (see the registration page for specific wording) and complete the registration process, or you use the service in any way, you are deemed to have read and agreed to be bound by the above agreement, rules, etc.

 

If you have any violation of this agreement, Guangzhou Fairland Technology Co., Ltd. has the right to unilaterally take measures such as restricting, suspending or terminating the provision of services to you at any time according to your violation, and has the right to hold you accountable.

 

This service agreement (hereinafter referred to as "this agreement") is jointly signed by you and Guangzhou Fairland Technology Co., Ltd. Including but not limited to: "Guangzhou Fairland Technology Co., Ltd. Privacy Policy" and so on. If there is any change, Guangzhou Fairland Technology Co., Ltd. will make an announcement by sending a message in the licensed software without prior notice. Once the changed agreement and rules are announced, they will automatically become a part of this agreement, without further notice to you for consent. If you do not agree to the relevant changes, please immediately stop using the services of Guangzhou Fairland Technology Co., Ltd.; if you continue to use, it is deemed that you have no objection to the revised rules and agree to abide by them.

 

1. Definition of Terms

1.1. Licensed Software: refers to the software system provided by Guangzhou Fairland Technology Co., Ltd. for you to download and install and use in a limited system mobile terminal.

1.2. Services: the services provided by Guangzhou Fairland Technology Co., Ltd. and its suppliers. You can use the service on a mobile terminal through the licensed software.

 

2. Service

2.1. Guangzhou Fairland Technology Co., Ltd. and its suppliers provide you with smart living equipment management services. You can control and connect to the supplier cloud platform of Guangzhou Fairland Technology Co., Ltd. through Guangzhou Fairland Technology Co., Ltd. Smart terminals, and realize the linkage between smart devices. The service content includes smart device management, scene linkage, analysis reports, etc. These functional services may be optimized or modified according to changes in your needs or the unilateral judgment of the service provider, and may also temporarily stop providing services due to regular or irregular maintenance.

 

3. Service S cope

3.1. Subject to this agreement, Guangzhou Fairland Technology Co., Ltd. grants you the right to use the licensed software.

3.2. You may not license, sell, lease, transfer, distribute or otherwise use the Licensed Software in any form.

3.3. Due to the licensed software adaptation platform and terminal restrictions, you can only use the licensed software on authorized system platforms and terminals. If you install the licensed software on other terminal devices, it may cause damage to your hardware or software functions.

3.4. You should understand that the licensed software can only be used for non-commercial purposes, and you cannot install, use, or run the licensed software for commercial operation purposes.

3.5. Guangzhou Fairland Technology Co., Ltd. and its suppliers will change, upgrade or transfer the licensed software and its related functions from time to time, and may add new functions or services to the licensed software system. If there is no independent agreement for the above-mentioned new functions and services, you can still obtain authorization for the corresponding functions and services, and this agreement applies.

3.6. You shall be responsible for the accuracy, reliability, completeness and legality of the data you input, as well as the legality of the way you obtain the data, and you shall back up data and materials regularly. You bear all risks for any damage or loss of such information.

3.7. You should keep your account number and password properly. If you find that your account has potential security risks (including but not limited to user password leaks), you should promptly notify Guangzhou Fairland Technology Co., Ltd. and will assist you in taking relevant measures. Otherwise, you are responsible for all actions under your account, and you shall bear all responsibilities.

 

4. T hird P arty

4.1. You have known that some services of Guangzhou Fairland Technology Co., Ltd. and its suppliers may be obtained based on software or services provided by a third party. legally authorized.

4.2. This product contains some information and services of third parties. Guangzhou Fairland Technology Co., Ltd. and its suppliers do not control the information and services of third parties.

4.3. You understand that Guangzhou Fairland Technology Co., Ltd. and its suppliers cannot guarantee that the licensed software will permanently use or include such third-party services, nor can they guarantee that they will continue to use other software or services provided by the same third party in the future, and may also use similar services of other third parties. Once the above-mentioned corresponding software or services are activated, the provisions of this agreement shall also apply.

 

5. Service Specifications

5.1. You should regulate the use of the licensed software, and the following methods are against the usage regulations:

• (1) Publish or share computer viruses, worms, malicious code, and software that intentionally damages or changes computer systems or data;

• ( 2) Collect information or data of other users without authorization, such as email addresses, etc.;

• ( 3) Maliciously use this product in an automated manner, causing excessive load on the server or interfering with or damaging the website server and network links in other ways;

• ( 4) Attempt to access server data or communication data of this product without authorization;

• ( 5) Interfering with or destroying the use of other users of this product.

 

5.2. You understand and agree that:

• ( 1 ) Guangzhou Fairland Technology Co., Ltd. will determine whether you are suspected of violating the above usage specifications, and suspend or terminate your use license or take other restrictive measures that can be taken in accordance with the agreement based on the determination results.

• ( 2 ) Guangzhou Fairland Technology Co., Ltd. will directly delete any information that is suspected of violating the law or violating the legal rights of others or violating this agreement when you use the licensed software.

• ( 3 ) For any damage caused to any third party by your violation of the above usage rules, you need to bear the legal responsibility independently in your own name, and you should ensure that Guangzhou Fairland Technology Co., Ltd. is free from losses or additional expenses arising therefrom, Otherwise, Guangzhou Fairland Technology Co., Ltd. has the right to claim compensation from you.

• ( 4 ) If you violate the relevant laws or the provisions of this agreement and cause Guangzhou Fairland Technology Co., Ltd. and its suppliers to suffer any losses, you shall compensate Guangzhou Fairland Technology Co., Ltd. and its suppliers for the losses caused thereby and/or expenses incurred.

 

6. Information C ontent S pecification

6.1. You promise not to use the service for any illegal or inappropriate activities, including but not limited to the following:

6.1.1. Upload, transmit or share information containing any of the following:

• (1) Those who oppose the basic principles established by the Constitution;

• (2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;

• (3) Damage to national honor and interests;

• (4) Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;

• (5) Undermining national religious policies, promoting heresy and feudal superstition;

• (6) Spreading rumors, disrupting social order, and undermining social stability;

• (7) Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crime;

• (8) Insulting or slandering others, infringing on the legal rights of others;

• (9) Contains false, deceptive, harmful, intimidating, invasive of the other 's privacy, harassing, infringing, defamatory, vulgar, obscene, or otherwise morally objectionable content;

• (10) Contains other content that is restricted or prohibited by applicable laws, regulations, rules, ordinances and any norms with legal effect.

 

7. Privacy Policy and Data

7.1. Protecting your personal information is very important to Guangzhou Fairland Technology Co., Ltd. Guangzhou Fairland Technology Co., Ltd. has formulated the "Guangzhou Fairland Technology Co., Ltd. Privacy Policy", which makes important disclosures on the ownership and protection of intellectual property rights, your information collection, use, sharing, storage, and protection. It is recommended that you read the "Guangzhou Fairland Technology Co., Ltd. Privacy Policy" completely.

 

8. Disclaimer

8.1. Except as clearly stipulated by laws and regulations, Guangzhou Fairland Technology Co., Ltd. will do its best to ensure that the licensed software and the technology and information involved are safe, effective, accurate and reliable, but limited by existing technologies, Guangzhou Fairland Technology Co., Ltd. cannot guarantee this.

8.2. You understand that for your direct or indirect losses caused by force majeure and third-party reasons, Guangzhou Fairland Technology Co., Ltd. cannot be held responsible.

8.3. You shall be solely responsible for any personal injury or incidental or indirect damages caused by or related to any of the following situations:

• (1) Unapproved use of licensed software or alteration of your data by third parties;

• (2) Expenses and losses arising from acts performed using the licensed software;

• (3) Your misunderstanding of the Licensed Software;

• (4) Other losses related to the licensed software not caused by Guangzhou Fairland Technology Co., Ltd.

8.4. Any other software derived from licensed software not developed by Guangzhou Fairland Technology Co., Ltd. or authorized by Guangzhou Fairland Technology Co., Ltd. to develop and officially release is illegal. Downloading, installing and using such software, may lead to unpredictable risks, and the resulting legal liabilities and disputes have nothing to do with Guangzhou Fairland Technology Co., Ltd. Guangzhou Fairland Technology Co., Ltd. has the right to suspend and terminate the license and/or all other services.

8.5. You are aware that the use of Guangzhou Fairland Technology Co., Ltd. supplier cloud platform involves Internet services, which may be affected by unstable factors in various links. This service may be due to inherent defects in the Internet and electronic communications and any party to this agreement. Suspension, interruption, delay, use restriction or use cannot be caused by time beyond reasonable control (including but not limited to fire, flood, terrorist attack, plague, natural disaster, riot, terminal virus, hacker attack, network failure, terminal failure). You hereby undertake the above risks hereby, and agree that Guangzhou Fairland Technology Co., Ltd. shall not be liable to you when the actual occurrence of the above risk events affects the normal operation of the service.

 

9. Agreement T ermination and L iability for B reach of C ontract

9.1. You should understand that you need to use the licensed software within the scope of authorization, respect the intellectual property rights of the licensed software and the content contained in the licensed software, use the licensed software in accordance with the specifications, and perform obligations in accordance with this agreement. If you seriously violate this agreement, Guangzhou Fairland Technology Co., Ltd. will terminate your license and require you to bear corresponding responsibilities.

9.2. Your use of the licensed software depends on the supporting services provided by Guangzhou Fairland Technology Co., Ltd. and its suppliers. If you violate the terms, agreements, Rules, notices and other relevant regulations may cause you to be unable to use the licensed software normally. Guangzhou Fairland Technology Co., Ltd. has the right to terminate the license or grant your license and other Guangzhou Fairland Technology Co., Ltd. in the manner agreed in the agreement. Controlling interests take restrictive measures, including suspending or terminating your license to use.

9.3. Once you violate this agreement or other agreements signed with Guangzhou Fairland Technology Co., Ltd., Guangzhou Fairland Technology Co., Ltd. and its suppliers have the right to take restrictive measures against your rights, including suspension and termination To provide you with some or all of the services, and publicize your breach of contract on the website operated or actually controlled by Guangzhou Fairland Technology Co., Ltd. and its suppliers

9.4. The licensed software is obtained by downloading from the download platform, and you need to abide by the terms and restrictions of the download platform, system platform, and terminal manufacturer on the way and restrictions on your use of the licensed software. Co., Ltd. and its suppliers, Guangzhou Fairland Technology Co., Ltd. may terminate the license to you due to third-party requirements.

9.5. When this license is terminated, you should stop using the licensed software and destroy all copies.

9.6. If you violate the terms of this agreement and cause losses to Guangzhou Fairland Technology Co., Ltd., its suppliers or other users, you must bear full liability for compensation.

 

10. Agreement T ermination and L iability for B reach of C ontract

10.1. The validity, interpretation, modification, execution and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China. If there is no relevant law, general international business practices and (or) industry practices shall be referred to.

10.2. For disputes arising from or related to this agreement, you can resolve them through friendly negotiation with Guangzhou Fairland Technology Co., Ltd. or submit them to the competent people's court in the place where this agreement is signed for adjudication.

10.3. When any provision of this agreement is ruled invalid by the competent people's court, it will not affect the validity of other provisions or any part thereof, and you and Guangzhou Fairland Technology Co., Ltd. should still perform them in good faith.
